Danny W. was
an employee of Peabody Coal Company who suffered a heart attack
while working the mine. White filed a workers compensation claim
against his employer and was subsequently terminated from employment
from the defendant. White alleged that the termination was in retaliation
for filing his workers compensation claim. The company claimed that
the plaintiff was terminated because of a mine closure and that
20 other employees were terminated at the same time and the termination
had no relationship to the plaintiff’s workers compensation
claim. The jury disagreed.
