Michelle, a 11 year old, suffered a brain injury
after being struck by a car while crossing the street while on her
way to a Girl Scout meeting. Although the car that hit Michelle
was driven by an uninsured driver, a substantial recovery was made
against a waste disposal company for obstructing the drivers view
of a school area where children were crossing the street.
An action was
brought against the school district due to their failure to provide
a crossing guard in a crossing location when the school knew that
children would be heading to a Girl Scout meeting. A recovery was
obtained against the highway department for their failure to provide
signs warning motorists that there were children present in the
area.
